1.1 These terms and conditions ("Terms") apply to all use of Maximum Savings (the "Platform"), accessible at https://www.maximumsavings.co.uk (the "Website"), which is owned and operated by Digi Reach, a company registered in England and Wales under company number 14163013, whose registered office is at C/O Eaccounts, Ground Floor, Cardigan House, Castle Court, Swansea, SA7 9LA ("we", "us", "our").
1.2 A "User" means anyone viewing or using the Website. Users may register to become "Members" in order to access discounts, cashback, offers and other benefits (each an "Offer") made available by participating brands and organisations ("Merchants").
1.3 By accessing or using the Website you agree to be bound by these Terms in full. If you do not agree to these Terms, you must not use the Website.
1.4 We may update or amend these Terms at any time. Continued use of the Website after any change takes effect will be treated as your acceptance of the revised Terms. You are responsible for checking this page from time to time for updates.
2.1 To become a Member you must be at least 18 years old, resident in United Kingdom, and provide accurate, current and complete information when you register.
2.2 Access to the Platform may be restricted to individuals who belong to a particular closed user group, workplace, membership scheme or organisation with which we have partnered (each a "Partner"). Where this applies, your right to use the Platform depends on your continuing relationship with the relevant Partner, and we may suspend or end your access if that relationship ends or if the Partner's agreement with us ends.
2.3 You may register directly on the Website, or, where a Partner has enabled it, via a single sign-on or referral link from the Partner's own site or app. Each individual may hold only one account.
2.4 We may refuse an application to register, or approve it subject to conditions, at our reasonable discretion.
3.1 Offers are made available for the personal use of the individual Member who is logged into their account. Members must not share, resell, publish or otherwise make an Offer, discount code, or their login details available to any other person or organisation.
3.2 Where a Member uses an Offer, they may be redirected to a Merchant's own website or point of sale to complete a purchase. Any purchase is made directly between the Member and the Merchant, and the Merchant is solely responsible for the sale, its fulfilment, and any related customer service, returns or refunds.
3.3 We display Offers as supplied to us by Merchants and are not responsible for errors, expired Offers, or Offers withdrawn or amended by a Merchant without notice.
3.4 If an Offer does not work as described, Members should contact us at support@maximumsavings.co.uk in the first instance.
4.1 "Member Offers" means discounts or benefits made available to Members that are not available to the general public.
4.2 "General Offers" means discounts or promotions that are also available to non-Members, which we may nonetheless choose to feature on the Platform.
5.1 You are responsible for keeping your username and password confidential and for all activity that takes place under your account.
5.2 You must keep your account details accurate and up to date, and must tell us promptly at support@maximumsavings.co.uk of any change (for example, a change of email address) or of any suspected unauthorised use of your account.
5.3 We may require you to change your password or other account details at any time, for security reasons.
6.1 We will use reasonable efforts to keep the Website available, but we do not guarantee that it will be uninterrupted, secure or error-free, and the Website is provided on an "as is" and "as available" basis.
6.2 We may suspend, withdraw, restrict or change all or part of the Website at any time, including for maintenance, security or commercial reasons, and we will give notice where reasonably practicable.
6.3 The Website may contain links to third-party websites, including Merchant websites, which we do not control and are not responsible for.
7.1 All content on the Website, including text, graphics, logos and software, is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws.
7.2 We grant Members a limited, personal, non-transferable, non-commercial licence to view and use the Website. You must not copy, reproduce, republish, distribute, or create derivative works from any part of the Website or its content without our prior written permission, other than saving or printing pages for your own personal, non-commercial use (for example, to keep a record of an Offer).
8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
8.2 Subject to clause 8.1, we will not be liable to you for any indirect or consequential loss, or for any loss of profits, revenue, business, goodwill or data, arising out of or in connection with your use of the Website or any Offer.
8.3 Subject to clause 8.1, our total liability to you in connection with the Website and these Terms in any 24 month period will not exceed £100.
8.4 We are not a party to, and accept no liability arising from, any transaction, contract or dispute between a Member and a Merchant.
8.5 You agree to indemnify us against any liabilities, costs, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Website.
9.1 We may suspend or terminate your account or access to the Website, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or if your eligibility under clause 2 ends.
9.2 You may close your account at any time by contacting us at support@maximumsavings.co.uk.
10.1 If you have a question, or wish to make a complaint, please contact us at support@maximumsavings.co.uk or by post at C/O Eaccounts, Ground Floor, Cardigan House, Castle Court, Swansea, SA7 9LA. We aim to respond within 5 days.
11.1 You may not transfer your rights or obligations under these Terms to anyone else. We may transfer our rights and obligations under these Terms to another organisation, and we will tell you if this happens.
11.2 If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.
11.3 If we do not enforce any right or provision of these Terms immediately, this will not be treated as a waiver of that right.
11.4 These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales
